The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 120B of the Indian Penal Code.
The prosecution case is that a land appertaining to Thana No. 116, Khata No. 282 measuring an area of one katha eight dhur belonging to the informant and his brother Harendra Prasad Jaiswal was transferred by registered sale deed in favour of Sheshnath Mahto and Dinanath Mahto by the petitioner.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.23433 of 2016 (2) dt.24-05-2016 2/2 petitioner that the petitioner is cousin of the informant and the said land was purchased by Rambriksh Mahto, the grand father of the petitioner, from Khedaru Mahto alias Sitaram Mahto. Considering the accusation levelled in the background of land dispute between the parties coupled with the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Barriya P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
