The petitioner is apprehending his arrest in connection with K. Nagar P.S. Case No. 164 of 2014, registered under sections 376 and 511 of the Indian Penal Code. Allegation against the petitioner is committing an attempt of rape upon the informant and there is direct allegation against him.
It has been submitted on behalf of the petitioner that he is the next door neighbour of the informant and he has been falsely implicated in this case.
Heard learned A.P.P. also who has opposed the prayer for bail.
Having heard both sides and in view of the aforesaid
Patna High Court Cr.Misc. No.17959 of 2017 (2) dt.01-05-2017 facts, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed accordingly.
