JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named and from perusal of the impugned order it would appear that except confessional statements, the concerned investigating officer could not succeed to collect any material against the petitioner. Moreover, having more or less similar allegation, one co-accused has already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
Patna High Court Cr.Misc. No.23783 of 2016 (3) dt.13-07-2016 2/2 two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-7, Gaya in connection with Delha P.S. Case No. 105 of 2015.
