====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 384 and 386 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.07.2021, charge-sheet has been submitted and has antecedent of two cases.

The informant alleges that he received a call on his mobile from mobile no. 8678009162 and the caller demanded extortion of Rs.5,00,000/-. Accordingly, the FIR was instituted against the caller of the aforesaid mobile number.

No.68048 of 2021(2) dt.20-04-2022 2/2 Learned counsel for the petitioner submits that FIR was instituted based on the call received and the mobile does not belong to the petitioner. The petitioner was arrested in Chhatauni P.S. Case No. 222 of 2021 and was made to confess his participation in the present occurrence.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.07.2021, charge-sheet has been submitted and name of the petitioner transpired based on his own confessional statement and the mobile does not belong to the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Motihari Town P.S. Case No. 361 of 2021, one of the bailors shall be the father (Sambhu Sahani) of the petitioner. (Satyavrat Verma, J) Kundan/- U T
