JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-08-2019 Grievance of the petitioner in the present writ application is non payment of salary for the period May, 2017 to May, 2018 and from July 2018 on wards.

Taking work and denying salary amounts to beggari which is violation of Article 23 of the Constitution of India. The petitioner claims that he was validly appointed and regularly working but he has not been paid salary. The aforesaid contention requires factual enquiry at the level of District Programme Officer (Establishment), Jamui.

Accordingly, the writ petition is disposed of with a

Patna High Court CWJC No.16463 of 2019(2) dt.16-08-2019 2/2 direction to the District Programme Officer (Establishment), Jamui to verify the matter to ascertain whether the appointment of the petitioner is legal and valid and whether he has actually worked for the period he is claiming salary and if it is found that the appointment of the petitioner is valid and legal and he has actually worked for the period he is claiming salary, necessary decision for grant of salary may be taken by the District Programme Officer (Establishment), Jamui within a period of sixty days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
