The petitioner apprehends his arrest in a case under Sections 392 and 120(B) of the Indian Penal Code. The petitioner is, of course, not named in the F.I.R. but his name figured in the case in the confessional statement of co-accused Rohit Kumar, from whose possession, many different looted articles were recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Dehri (T) P.S. Case No. 53 of 2015. Accordingly, the same is rejected. The petitioner is directed to surrender in the court below and the court below shall consider the prayer of regular bail

Patna High Court Cr.Misc. No.16621 of 2015 (2) dt.04-05-2015 2/2 of the petitioner without being prejudiced from this order and taking into consideration that other co-accused has been enlarged on regular bail.
