JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that uptill now; charge could not be framed against the petitioner, who is languishing in jail custody in this case since 24-04-2015.
Earlier prayer for bail of the petitioner was rejected by this court, taking note of his previous conduct as the petitioner was arrested even after 11 years of the occurrence and again, I am not inclined to release the petitioner on bail. Hence, his prayer for bail in connection with Sultanganj P.S. Case No. 514 of 2004 corresponding to Sessions Trial No. 731 of 2015 is, again rejected.

No.22330 of 2016 (3) dt.24-08-2016 2/2 However, learned trial court is directed to proceed with the trial of the petitioner by framing charge against him without any delay and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of copy of this order.
However, it is made clear that if, trial of the petitioner is not concluded within the above-said period of six months, the petitioner may renew his prayer for bail before the learned trial court itself.
