JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

It has been alleged by the informant that three motorcycle ridden criminals came at his place, took two litres of petrol and instead of paying for the same, tried to escape and on account thereof, scuffle took place. They have also pointed out pistol however, was snatched away. It has also been disclosed that leaving motorcycle all the three escaped. It has also been disclosed that his uncle along with the persons present there have identified all the three, namely, Guddu Das, Ratnesh Das and the third one petitioner Pawan Kumar Das. It has been submitted on behalf of the petitioner that he was mere a pillion rider and no allegation has been attributed against him specifically more particularly, pointing out pistol towards the prosecution party. It was Guddu Das against whom the allegation has been added. Furthermore, petitioner happens to be under custody since 07.11.2014.

Patna High Court Cr.Misc. No.17123 of 2015 (2) dt.30-04-2015 Accordingly, petitioner Pawan Kumar Das is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Khutauna P.S. Case No.88 of 2014.
