JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 30(a) (c) of the Bihar Prohibition and Excise Act on the ground that five litres of country made liquor has been recovered from the possession of the petitioner and petitioner has got no criminal antecedent. However, in view of the provision of Section 76(2) of Bihar Prohibition and Excise Act, 2016, this application is disposed of with liberty to the petitioner to surrender in the court below, i.e., Addl. Chief Judicial Magistrate, Barh, Patna, in connection with Barh P. S. Case no. 391 of 2016 and make prayer for regular bail on the basis of the submission as stated above.
