The petitioner, who is brother-in-law of the deceased, apprehends arrest in a case under sections 302,201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that he is an aged person, the marriage of the deceased took place 18/19 years back. He has no concern with the affairs of the deceased and his brother lives separately from him. Further, no matrimonial case was earlier lodged against the accused side. In the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- with two

No.16728 of 2015 (2) dt.13-04-2015 sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Bakhtiyarpur Police station Case No. 200 of 2014, with the condition that he would not be physically absent for two consecutive dates at a stretch till two witnesses are examined.
