JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 419, 420, 467, 468, 471, 34 of the Indian Penal Code.

Allegation against the petitioner is that informant entered into an agreement with petitioner and purchased some land. When informant wanted to construct boundary wall around the land purchased, another person objected to it and petitioner did not help her.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. The matter relates to sale and purchase of the land. Petitioner is the bonafide title holder of the land in question and at best he has executed a sale deed in favour of the informant but objection is being raised by one Dr. Eqbal. The matter relates to civil dispute.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender

Patna High Court Cr.Misc. No.25974 of 2016 (3) dt.12-07-2016 2/2 in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Simri P.S. Case no. 11 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
