The petitioner seeks bail in connection with Kotwa P.S. Case No. 45 of 2016 registered under Sections 272, 273 of the Indian Penal Code and Section 47(a), 53(c) and 54 of the Excise (Amendment) Act.

It is submitted by the learned counsel for the petitioner that neither the hut from where 8 liter illicit countrymade liquor is alleged to have been recovered nor the orchard belonged to the petitioner.

Be that as it may, regard being had to the nature of allegation, the petitioner, who is in custody since 4th April, 2016,

Patna High Court Cr.Misc. No.21556 of 2016 (2) dt.19-05-2016 2 / 2 is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Kotwa P.S. Case No. 45 of 2016.
