The petitioner seeks bail in connection with Sessions Trial No.73 of 2014 arising out of Paraiya P.S.Case No. 82 of 2013 registered under sections 328 and 302 read with 34 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected on 10.04.2014 in Cr.Misc. No. 54389 of 2013. He again renewed his prayer for bail, which was also rejected by me vide order dated 16.09.2014 passed in Cr.Misc. No. 30558 of 2014. Learned counsel for the petitioner has contended that till date only four witnesses have been examined in course of trial and the trial of the petitioner is not likely to be concluded in near
Patna High Court Cr.Misc. No.19693 of 2015 (2) dt.29-04-2015 2/2 future.
Be that as it may, regard being had to the fact that the F.I.R. is based on oral dying declaration of the informant in which she has alleged that the petitioner being her husband had forcibly administered poison to her, I am not inclined to grant bail to the petitioner.
