JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 5.4.2016 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

The prosecution case is that during vehicle check the informant being police officer intercepted a motorcycle on which two persons were travelling and from a carton kept on the motorcycle 110 sealed bottles of Corex cough syrup of 100 ml each were recovered.

It is submitted by the learned counsel for the petitioner that the seized bottles were of cough syrup which are widely used and there is nothing on record to show that the petitioner was selling the same for illegal purposes. Statement has been made in

Patna High Court Cr.Misc. No.21828 of 2016 (2) dt.18-05-2016 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Araria in connection with Jogbani P.S. Case No. 41 of 2016. The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioner. (Dinesh Kumar Singh, J) Anil/- U T
