2. Learned counsel for the petitioners seeks permission to correct the spelling of the name of petitioner no.2. It is submitted that inadvertently "Pradhu Das" has been typed in the cause title in place 'Prabhu Das'. Permission is granted.
3. Office shall ensure that necessary correction in the name of the petitioner no. 2 is also made in the CIS/data base relating to this case.
4. The petitioners seek bail in connection with Manigachhi PS Case No.50 of 2025 dated 20.04.2025, instituted for the offence punishable under Sections 329(4), 126(2),
Patna High Court CR. MISC. No.55751 of 2025(2) dt.12-08-2025 2/3 115(2), 118(2), 109(1), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
5. The allegation against the petitioners is that they were part of the unlawful assembly which entered into the house of the informant, and then they abused and assaulted the informant as well as others. The accused persons assaulted repeatedly the injured. It is alleged that total six persons sustained injuries in the scuffle.
6. Learned counsel for the petitioners submits that specific allegation against petitioner no.1, Heera Das, is that he assaulted Dharamveer by means of farsa and he sustained injury. There is no specific allegation against petitioner no.2. Further submission is that the doctor has opined that all the injuries on the person of injured Dharamveer were simple in nature. There is land dispute between the parties. Both the parties are neighbours. There is case and counter case between the parties. Lastly, it is submitted that the petitioners are in custody since 02.05.2025 having clean antecedents.
7. Learned APP has opposed the prayer for bail.
8. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of
Patna High Court CR. MISC. No.55751 of 2025(2) dt.12-08-2025 3/3 Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-VI, Darbhanga, in Manigachhi PS Case No.50 of 2025.
9. The application stands allowed.
