JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,324,326,307 and 379 of the Indian Penal Code. Later on, sections 386 and 411/34 IPC were added.

It is alleged against co accused Lalku Yadav to have assaulted with stick to the informant and caused teeth bite. It is also alleged against petitioner no. 1 Veena Yadav to have caused teeth bite on left ear of the informant whereas it is specifically alleged against petitioner no. 2 to have snatched rupees five thousand from the informant.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.17396 of 2015 (2) dt.13-05-2015 2/2 that the accusation is not specific against petitioner no. 2 and due to petty dispute the accusation has been levelled. Considering the fact that petitioner no. 1 is accused in five other cases apart from the present one, let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case the petitioner no.1 surrenders within six weeks from today in connection with Bihta P.S. Case No. 523 of 2014 pending in the court of learned A.C.J.M., Danapur, Patna.

Considering the nature of accusation against petitioner no. 2 having no criminal antecedent, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
