The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 341, 328, 452, 352, 307 and 379/34 of the Indian Penal Code. From the record it appears that accused persons entered into the courtyard of the informant and assaulted him. It has been alleged that Mahendra Rai and Ajay Rai caught hold the informant and Ram Babu Prasad put plastic rope around his neck and started pressing his neck on account of which the informant felt suffocation. It has further been alleged that when Anita Devi wife of the informant came to save him, Baidhnath Rai and Ganga Sah
Patna High Court Cr.Misc. No.18059 of 2015 (3) dt.09-07-2015 pushed her down and assaulted her with fists and slaps and also snatched away a golden chain from her neck. Learned counsel for the petitioner submits that there is no allegation of assault against the lady. There is series of litigation in between the parties.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Ganga Sah, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No.418 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure.
