Patna High Court CWJC No.19933 of 2021(3) dt.19-11-2025 2/3 19-11-2025 Heard Mr. Jitendra Prasad Singh, learned senior Counsel for the petitioner and Mr. Atul Shankar learned AC to SC-19 for the State-respondents.

The main grievance raised by the petitioner in this writ application is that the petitioner's Jamabandi Cancellation Case No. 70/2019-20 filed by him before the Additional Collector is not being decided and the same is kept pending by the Additional Collector, Nawada, without any reason and due to this delay the petitioner has become helpless to get the relief in the light of the judgment and decree passed by the civil court in Title Suit No. 188 of 2007.

Learned counsel appearing for the Staterespondents submits that the issue relating to the relief sought by the petitioner in this writ petition for cancellation of Jamabandi running in the name of private respondents is premature for consideration before this court under its writ jurisdiction, however, the Additional Collector, Nawada where the petitioner's Jamabandi Cancellation case is pending may be directed to decide his case at the earliest.

4. Considering the aforesaid submissions, the Additional Collector, Nawada, respondent no. 3 is directed to decide the Jamabandi Cancellation Case No. 70/2019-20 as per

Patna High Court CWJC No.19933 of 2021(3) dt.19-11-2025 3/3 the provisions of law and according to merit within three months from the date of receipt/production of a copy of this order after giving sufficient opportunity of hearing to all the parties.

5. Accordingly, the instant writ petition stands disposed of.
