JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

It is alleged that the minor daughter and the wife of the informant went to ease out when one Shaligram Mandal along with one unknown abducted the daughter of the informant. The wife of the informant informed the informant about the occurrence, thereafter the informant went to the house of Shaligram Mandal where his parents assured the informant to locate the daughter of the informant. The petitioner was not named in the FIR. His name sprang up during investigation. It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.17478 of 2015 (2) dt.14-05-2015 2/2 that the accusation is specific against Shaligram Mandal and the name of petitioner subsequently sprang up on suspicion. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Co accused Rojan alias Ranju Singh and Ramchandra Mandal have been granted anticipatory bail vide Cr. Misc. Nos. 34170 and 34394 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Basnahi P.S. Case No. 24 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
