The petitioner seeks bail in a case registered under Sections 302, 201 of the Indian Penal Code.
Allegation is that the petitioner killed the daughter of the informant and disappeared her dead body.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.4.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no eye witness to the alleged occurrence. The name of the petitioner has transpired in this case merely on the basis of suspicion. Except for suspicion,
Patna High Court CR. MISC. No.54299 of 2019(2) dt.30-08-2019 2/2 there is no other substantive evidence to suggest the implication of the petitioner in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bagaha, District West Champaran in connection with Gobardhana P.S. case No.19 of 2019.
