The petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.06.2021, charge-sheet has been submitted in the case and has antecedent of three cases. Learned counsel for the petitioner submits that the informant alleges that he saw the lock of the gate of his cousin brother broken, accordingly information was given to the police and his cousin informed about the theft of the articles as detailed in the F.I.R.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.67611 of 2021(2) dt.20-04-2022 2/2 allegation is of committing theft in the house of cousin brother of the informant by unknown accused. It is further submitted that the name of this petitioner transpired in the confessional statement of Md. Samim Ansari and Shibu Sahani which has no evidentiary value. It is further submitted that Shibu Sahani has been granted bail vide order dated 22.03.2022 passed in Cr. Misc. No. 61362 of 2021.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.06.2021, charge-sheet has been submitted in the case and the co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sursand (Bihta O.P.) P.S. Case No. 56 of 2021.
