JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Palasi P.S. Case No. 252 of 2016 instituted for the offence under sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code. It is submitted that there is case and counter case. It is further submitted that for the same occurrence, the petitioner has lodged Palasi P.S. Case No. 251 of 2016 against informant party in which the petitioner sustained grievous injury (Annexure-4).

In the instant case, it is alleged against this petitioner that he assaulted the father of the informant with iron rod. The injury report of father of the informant Hira Lal Sah is Annexure-3 wherein the doctor has found lacerated wound

Patna High Court Cr.Misc. No.10677 of 2017 (2) dt.10-03-2017 2/2 over fore head which is simple in nature.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Palasi Case No. 252 of 2016 he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Raghubansh Narayan, Additional Chief Judicial Magistrate-III, Araria, subject to the conditions as laid down under Section 438(2) Cr.P.C.
