The petitioner seeks bail in Supaul P.S. Case No. 119 of 2018 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.
It is alleged in the Fard-e-beyan that dead body of son of the informant was recovered from the Mango orchard. Counsel for the petitioner submits that First Information Report is against unknown. The name of petitioner has come during investigation on the ground that deceased had love affairs with married daughter of this petitioner. Case diary has been received.
Counsel for the informant has appeared and submitted
Patna High Court Cr.Misc. No.49717 of 2018 (3) dt.29-10-2018 2/2 that in paragraphs 7, 8 and 9 of the case diary, the witnesses have taken the name of this petitioner.
Learned A.P.P. after looking into the case diary has submitted that mere suspicion has been raised against the petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 119 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
