The petitioners apprehend their arrest in Kishanpur P.S. case No.15 of 2014 under Section 307, 380, 354 and some other sections of the Indian Penal Code.
The petitioner, Pravin Kumar Rai, is alleged to have assaulted Ram Kumar Rai with butt of gun and also broke his leg. Petitioner, Sadanand Rai, assaulted Yogendra Rai with iron rod. It is submitted that Ram Kumar Rai got one abrasion and another lacerated wound and both injuries are simple in nature. Yogendra Rai also got one injury which is simple in nature. The occurrence took place due to land dispute and similarly situated accused, Upendra Rai, has already been granted anticipatory bail vide order passed in Cr. Misc. No. 17432 of
Patna High Court Cr.Misc. No.21827 of 2016 (2) dt.21-07-2016 2/2 2015. The petitioners have got no criminal antecedent. Considering the fact that on account of assault made by the petitioners simple injuries were caused and the occurrence took place due to land dispute, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jitendra Kumar, learned Judicial Magistrate, Supaul in Kishanpur P.S. Case No. 15 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
