Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47A of the Excise Act.

The prosecution case is that 60 liters of illicit country made liquor were recovered from the house of petitioner on 17.09.2008. Though, the prosecution report was transmitted to the court on 30.01.2009.

It is submitted by the learned counsel for the petitioner that recovery is from the joint family house of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.23890 of 2016 (2) dt.26-05-2016 regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Excise P.S. Case No. 54 of 2009, pending in the court of learned Chief Judicial Magistrate, Bhojpur at Arrah.

With the above observation this application is disposed of.
