JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Madanpur P.S. Case No. 177 of 2009 instituted for the offence under Sections 147, 148, 149, 341, 427 of the Indian Penal Code, Sections 3⁄4 of Explosive Substance Act and Section 17 of C.L.A Act.
Counsel for the petitioner submits that petitioner is in custody in the instant case since 30.4.2016.
In the written report there is no allegation of any specific overt act against the petitioner. Petitioner is named in the written report. There is general and omnibus allegation against the petitioner and other accused persons. It is mentioned in the written report that all the accused persons were taking name of each other and on that basis the name of petitioner has come.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Aurangabad, in connection with Madanpur P.S. Case No. 177 of 2009, subject to the condition that both the bailors will be the close relatives of the petitioner.
