JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that the father of the informant namely, Jagdish Singh went to his agricultural field on 6.11.2015, in the meantime, the accused persons including the petitioners assaulted with lathi, country made pistol and other weapons. In course of fleeing away, the father of the informant fell into a river, thereafter he received internal injuries. The father of the informant was brought to the Sadar hospital but he died during treatment. It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.29001 of 2016 (4) dt.01-09-2016 2/2 that the accusation is not being corroborated with the postmortem report as the postmortem report does not suggest any external or internal injury and as per opinion of the doctor the death occurred due to cardiac arrest. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation not being corroborated by the medical opinion, a co-ordinate bench of this court granted anticipatory bail to co accused Kakeshwar Singh and Neeraj Kumar vide Cr. Misc. No. 20996 of 2016.
In the circumstances, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sasaram, in connection with Sasaram Nagar (Darigaon) P.S. Case No. 1244 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
