Petitioners seeks bail in connection with S.Tr. No. 446 of 2017 arising out of Khajekalan P.S. Case No. 271 of 2014 registered for the offence punishable under Sections 147, 148, 149, 324, 307, 379, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Informant in her written complaint has stated that on 16.11.2014 at about 09:30 pm while the Informant along with her husband were in Cow Shed, petitioner along with FIR named accused persons came there and started firing indiscriminately which led to death of her husband. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to previous enmity. Petitioner is in custody since 16.02.2017.

Patna High Court Cr.Misc. No.46670 of 2018(5) dt.25-10-2018 2/2 Considering the fact that there is direct allegation of firing against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
