JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bihta P.S. Case No. 49 of 2017 instituted for the offence under sections 25(1b)a/26/35 of the Arms Act. As per written report, one Deepak Kumar was apprehended with fire-arms by the police.

The seizure list was prepared which bears his signature.

It has further been alleged that the apprehended accused disclosed the name of this petitioner. The petitioner took loan of Rs. 10,000/- and in lieu of return of the aforesaid amount, he gave the said two pistols to Deepak Thakur which were brought by Sams Ahmad.

His name has been disclosed by coaccused who was apprehended by the police. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Bihta P.S. Case No. 49/2017 G.R. No. 340/2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
