JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 26.04.2018, seeks bail in connection with Pirbahore P.S.Case No. 233 of 2018 registered under Sections 274, 275, 276, 420, 467, 468 and 120B of the Indian penal Code and 27(c),27(b)(ii), 27(d)28 and 28A of the Drugs and Cosmetic Act, 2008.
Accusation is that spurious medicines were recovered from M/s Patna Pharma and M/s Aman Distributor and that was seized by the Drug Inspector and it was disclosed that the owner used to purchase the medicines from one Vikash Kumar and Vikas Kumar had purchased those medicines from this petitioner and this petitioner had purchased it from Dhanraj and this petitioner was also found present at Patna Pharma. Learned counsel for the petitioner contends that this

No.46633 of 2018(3) dt.10-08-2018 2/2 petitioner had gone to medical shop for purchasing medicines prescribed for his father, however, there is nothing against the petitioner except the allegation that the owner of the shop purchased the medicines from Vikash and not from this petitioner and the petitioner has no concern with the drug business and charge-sheet has been submitted in this case. Having considered the aforesaid facts and circumstances, the petitioner, namely, Sameer Sharma @Sameer is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st, Patna in connection with Pirbahore P.S. Case No. 233 of 2018.
