JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Amarpur P.S. Case No. 48 of 2016 instituted for the offence under sections 302, 376, 201/34 of the Indian Penal Code and Section 4 of the Posco Act.

It is alleged in the written report that dead body of minor daughter of the informant was recovered from a pond. The informant has raised suspicion against one Barun Sangahi. From the written report, it appears that Barun Sangahi has committed murder of daughter of the informant after doing illegal act with her along with other associates. Case diary has been received.

The learned A.P.P. has submitted that one Barun

Patna High Court Cr.Misc. No.6090 of 2017 (4) dt.21-03-2017 2/2 Sangahi in his confessional statement before police has taken name of this petitioner. Similar statement has been made in the impugned order by learned Sessions Judge from which, it appears that name of this petitioner has come in the confessional statement of co-accused Barun Sangahi.

In this manner, petitioner is not named in the written report and besides this, his name has come in the confessional statement of co-accused, there is no any specific over act against this petitioner.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Amarpur P.S. Case No. 48 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to the conditions as laid down under Section 438(2) Cr.P.C.
