ANJANA MISHRA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Complaint Case No. 6990 of 2015 registered for the offences punishable under Sections 147/148/376/302/341/504 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that these petitioners have been falsely implicated in this case on account of another case being filed by one Sharda Devi against the complainant of the present case.
Having heard learned counsel for the petitioners and learned
Patna High Court Cr.Misc. No.24210 of 2016 (3) dt.12-08-2016 P2/2 counsel appearing on behalf of the State and after perusing all the materials on record including the complaint petition in both the cases, I find that it is a case of gang-rape in which the victim was brutally assaulted and she succumbed to her injuries on account of the said gang-rape.
As such, I am not inclined to release the petitioners on anticipatory bail. It is accordingly rejected. (Anjana Mishra, J) Saif/- U T
