The petitioners are apprehending their arrest in connection with Manjhi P.S.Case No. 240 of 2016 registered for the offences punishable under Sections 147, 148, 341, 323, 307, 379 and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that there is case and counter case between the parties and no specific allegation has been alleged against any of the petitioners and so far allegation of demand is concerned, the same is ornamental in nature and the allegation of assault is against other accused persons.

Having heard both sides and considering the fact that there is case and counter case and there is no specific allegation of assault against any of the petitioners, let the petitioners, above named, in the event of their arrest or surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Vth. Saran at Chapra, in connection with Manjhi P.S.Case No. 240 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the conditions that petitioners will co-operate in the investigation and appear before the police, as and when required, and on failure on their part to appear before the police on two consecutive occasions, without showing any valid reason, their bail bonds shall be liable to be cancelled.
