The petitioner is languishing in custody in connection with Rasulpur P.S. Case No. 01 of 2016 for the offences instituted under Sections 364 & 120(B) of the Indian Penal Code. Later on Section 302 of the Indian Penal code was added. There is complicity of the petitioner in the alleged occurrence that he along with other co-accused persons kidnapped the husband of the informant and thereafter killed him. It has been submitted on behalf of the petitioner that petitioner is in custody since 30.01.2016. Charge sheet has been submitted in this case. There is no criminal antecedent against the petitioner. The petitioner is not named in the F.I.R. Except for the
Patna High Court Cr.Misc. No.22582 of 2016 (3) dt.03-08-2016 2/2 confession of the petitioner, there is no other substantive evidence to show the involvement of the petitioner in the present case. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- 10th, Saran at Chapra, in connection with Rasulpur P.S. Case No. 01 of 2016.
