Informant Anuj Kumar along with deceased, Sonu and Vijay Gupta, as desired by Dhiraj who instructed Sonu over his mobile no. 8210762068, had gone to Sahuka canal, where Dhiraj came along with others out of whom, Sonu addressed one person as Pahalwan Chacha and during course thereof, Dhiraj and Sonu indulged in scuffle which was pacified by aforesaid Pahalwan Chacha. During course of return while Sonu was about to sit on the scooty, Dhiraj took out pistol and shot at Sonu causing injury upon him, who during course of taking away to Varanasi, succumbed in the midst of way. From perusal of the case diary, it is evident that

No.54271 of 2019(3) dt.27-11-2019 2/2 allegation remained intact with regard to Dhiraj being an assailant, though some of the witnesses have shown presence of petitioner, Bittu Singh at the spot, and in the aforesaid background, petitioner, Bittu Singh @ Bittu Kumar Yadav, in the event of arrest/surrender within four weeks, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Bhabua at Kaimur in connection with Ramgarh PS Case No. 32/2019, subject to the condition as laid down under Section 438(2) CrPC.
