2. This matter has been listed under the heading 'For Orders (On Office Notes)' for perusal of the office notes and earlier vide order dated 13.10.2022, notice was issued to respondent no.5.

During the course of hearing, learned counsel for the petitioner submits that the present writ application was occasioned to be filed because of the reason that appeal bearing Appeal No.08 of 2020, which was preferred before the District Appellate Authority, Arwal, was not being heard owing to the

Patna High Court CWJC No.20287 of 2021(3) dt.18-08-2025 2/2 said forum not being functional. At this stage, learned counsel for the petitioner submits that now the District Appellate Authority, Arwal, is functional and therefore, he seeks permission to withdraw this writ application to get his issue adjudicated by the appropriate forum which has been created under the legislation.

4. Since the petitioner wants to pursue his remedies before the appropriate forum, in such view of the matter, this petition is directed to be withdrawn with liberty aforesaid.

5. It is expected that the District Appellate Authority, Arwal, shall take all endeavours to decide the issue at the earliest, preferably within a period of three months from the date of production/receipt of a copy of this order.

6. Accordingly, this writ application stands disposed of.
