JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 02.07.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is in jail custody since 7.7.2011 in a case registered under section 366A/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was thrice rejected by this court.

Learned counsel for the petitioner submits that the petitioner was put on trial before learned Addl. Sessions Judge and in course of trial, prosecution completed its evidence. Thereafter, statement under section 313 of the Cr.P.C was recorded and case was heard and posted for judgment but on the day of judgment, learned trial court adjourned the pronouncement of judgment and issued summons against doctor and Investigating officer.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of

No.21687 of 2015 (2) dt.02-07-2015 detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IV, Motihari in Sessions trial no. 206/2012 arising out of Kalyanpur P.S. Case no. 118/2010.
