ANJANA MISHRA ORAL ORDER 02-06-2016 Learned counsel for the petitioner filed supplementary affidavit making the necessary correction in para-1 of the present petition.
Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 12.03.2016 in connection with Begusarai Muffasil P.S. Case No. 105 of 2016 registered for the offences punishable under Sections 461 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is named in the F.I.R. but there is no recovery from the conscious possession of the petitioner. It is further submitted that there was a dispute regarding the payment of
Patna High Court Cr.Misc. No.24504 of 2016 (2) dt.02-06-2016 2/2 wages between himself and the Godown Manager which resulted in lodging the present case in a mala fide manner. It is further submitted that two persons who had allegedly entered with a pick up van in the godown and were loading the sugar on the vehicle, escaped whereas the petitioner was taken into custody for no fault of his.
Considering the nature of allegations and that the petitioner has been in custody for the past two months, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 105 of 2016.
