The petitioner apprehends his arrest in Buxar (Town) P.S. Case No. 01 of 2017 instituted for the offence under sections 272, 273, 414/34 of the Indian Penal Code and 30(A) of Bihar Excise Amendment Act, 2016.

It is submitted that Sandeep Kushwara with similar allegation has been granted anticipatory bail by this court in Cr. Misc. No. 6796 of 2017 vide order dated 21.2.2017. The name of the this petitioner has been disclosed by the driver Jai Prakash Yadav who was apprehended on the spot. The petitioner was not present on the spot. There is no recovery of any incriminating articles from the possession of this petitioner. Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.9220 of 2017 (2) dt.01-03-2017 of the case, prayer for bail of the petitioner is allowed. In the event surrender/arrest of the petitioner, named above, within six weeks from today, in connection Buxar (Town) P.S. Case No. 01 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the lie amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under section 438(2) Cr.P.C.
