Petitioner seeks bail in Imamganj P.S. Case No.18 of 2018 instituted for the offence under Section(s) 364, 302, 201 and 120-B/34 Indian Penal Code.
Counsel for the petitioner submits that mere suspicion has been raised against the petitioner by the informant in the written report.
In the written report, it is alleged that informant did not find his brother and sister-in-law (Bhabhi). Later on, their dead bodies were found in forest. Informant has raised suspicion against the petitioner.
It has been submitted that co-accused, Anuj Kumar, has been granted bail by co-ordinate Bench of this Court by order
Patna High Court Cr.Misc. No.49905 of 2018 (3) dt.26-10-2018 2/2 dated 28.06.2018 passed in Cr. Misc. No.36049 of 2018. Petitioner is said to be in custody since 06.03.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Imamganj P.S. Case No.18 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
