JUSTICE SANJAY PRIYA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Chapra Muffasil P. S. Case No. 78 of 2012 instituted for the offence under Section 304B/34 of the Indian Penal Code.

Petitioner is the husband of the deceased.

It is alleged in the written report that this petitioner along with other accused persons committed murder of the daughter of the informant by throttling.

Learned counsel for the petitioner has submitted that a compromise has taken place between the petitioner and the informant. This Court is of the view that offence u/s 304 B of the I.P.C. is non compoundable.

There is specific allegation of overt act against this

Patna High Court Cr.Misc. No.50668 of 2018(3) dt.22-11-2018 2/2 petitioner. Therefore, this Court is not inclined to grant bail to the petitioner. The prayer for bail of the petitioner stands rejected at this stage.

Trial Court is directed to expedite the trial by giving short adjournments and make efforts to conclude the same as early as possible.
