The petitioner apprehends his arrest in Chand P.S. Case No. 90 of 2016 instituted for the offence under Section (s) 175, 420, 409, 120B, 201 of the Indian Penal Code. It has been alleged that petitioner did not submit the folders with regard to appointment of Panchayat Teachers of Sirhara Panchayat of Chand Block, District Bhabua. The petitioner has annexed Annexure-2 and submitted that he has joined in the aforesaid panchayat on 15.12.2014. It has further been submitted that folders were being demanded for the periods 2003, 2005, 2006 and 2012. The petitioner has also annexed Annexure-4,

Patna High Court Cr.Misc. No.12987 of 2017 (2) dt.23-03-2017 2/2 wherein he has informed to the Block Development Officer, Chand that his predecessor Tulsi Ram has not given the charge of cash book and other documents to him.

The instant F.I.R has been field against the petitioner on 14.07.2016.

In such circumstance, the petitioner has given valid explanation vide Annexure-2 and 4 for not handing over the folder as demanded by the authority.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Chand P.S. Case No. 90 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
