The petitioners are apprehending their arrest in connection with Surajgarha P.S. Case No238 of 2016 lodged for the offences punishable under Sections 341,342, 323, 385, 387 and 307/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that there is only allegation against the petitioners and other coaccused persons that they have threatened the informant that he would not be released until an amount of Rs. 2 lacs was not paid by his father and thereafter some other co-accused persons assaulted but so far the allegation of amount of extortion that has not been found true during the course of investigation and it was found that there was some dispute with respect to the fare of

Patna High Court Cr.Misc. No.14853 of 2017 (2) dt.06-04-2017 2/2 tempo and in this case a counter case has been filed by the petitioners also. There is no specific allegation of assault against the petitioners.

Heard learned APP also.

Having heard both sides and in view of the facts stated above, let the petitioners, above named, in the event of their arrest or surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Surajgarha P.S. Case No. 238 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
