JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406/409/420/467/468/120B of the Indian Penal Code. It is alleged that co-accused Arun Kumar Sahni, realized Rs.1800/- from each consumer for providing new electric connections for which money receipt was also given.
Subsequently, the money receipt was found to be forged when coaccused Arun Kumar Sahni, confessed that he handed over the money to the petitioner, who is Executive Assistant, Electric Supply Sub-Division, Benipur, and it was the petitioner who issued the receipt with regard to money being received. It is submitted by learned counsel for the petitioner that none of the consumers have alleged that they have contacted the
Patna High Court Cr.Misc. No.22986 of 2016 (2) dt.23-05-2016 2/2 petitioner and ever got the receipt from the petitioner. In fact, they paid the money to co-accused Arun Kumar Sahni and they got the receipt from him.
Considering the thrust of accusation against co-accused Arun Kumar Sahni, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Benipur, Darbhanga, in connection with Bahera P.S. Case No.102/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
