29-04-2015 Heard learned counsel for the petitioner and Smt. Nirmala Kumari, learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail. Earlier bail petition of this petitioner alongwith bail petition of co-accused Fuleshwari Devi @ Fulapatiya Devi was rejected by this Court on 23-09-2014 on merit of the case.
Learned counsel for the petitioner again submits that it is not a case of dying declaration.
Fact remains that once order was already passed, there is no point to allow the learned counsel for the petitioner to reopen the same thing, which is already settled. There is no such change of circumstances so that the present petition may be entertained.
Patna High Court Cr.Misc. No.17673 of 2015 (2) dt.29-04-2015 2/2 The petition again stands rejected.
