The petitioner is the husband of the deceased. The wife of the petitioner was killed and her dead body was disposed of.
This is the second attempt of the petitioner for grant of bail. Earlier the prayer for bail was rejected vide order dated 20.01.2015 passed in Cr. Misc. No. 38763/2014 with a direction to the trial court to expedite the trial and conclude the same within one year from the date of receipt of a copy of that order. A report was called for from the learned trial court. It is submitted that more than one year has already elapsed but the trial has not yet been concluded but from perusal of the report it appears that the trial is likely to be concluded within three months. The learned Addl. Sessions Judge V, Begusarai has reported that five witnesses
Patna High Court Cr.Misc. No.22774 of 2016 (3) dt.23-11-2016 2/2 have already been examined.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in S. Tr. No. 665/2013 pending in the court of the learned Addl. Sessions Judge V, Begusarai. Accordingly the same is rejected.
The trial court is directed to hold the trial on day-today basis and conclude the same positively within four months from the date receipt of this order.
The Superintendent of Police, Begusarai is directed to ensure attendance of the remaining witnesses of S. Tr. No. 665/2013 in the court of the learned Addl. Sessions Judge V, Begusarai so that the trial must be concluded within four months. Let copy of this order be sent to the trial court and the Superintendent of Police, Begusarai for compliance. If the trial is not concluded within aforesaid period, the petitioner may renew his prayer for bail. (Prabhat Kumar Jha, J) Dilip/- U T
