The petitioner seeks bail in Atri P.S. Case No. 37 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, son-in-law of the informant left the house for some repairing work, but did not return. Informant suspects that all the accused persons named in the FIR committed murder of her son-in-law.

It is submitted on behalf of the petitioner that informant is not eye-witness of the occurrence. Petitioner has been made accused in this case only on suspicion. Save and except suspicion there is no substantive evidence to suggest his implication in this case. Similarly situated co-accused have been granted bail by this Court vide order dated 19.06.2020 passed in

Patna High Court CR. MISC. No.67517 of 2021(2) dt.28-02-2022 2/2 Cr. Misc. No. 1612 of 2020, order dated 10.02.2022 passed in Cr. Misc. No. 59956 of 2021. Petitioner is in custody since 18.08.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Gaya in connection with Atri P.S. Case No. 37 of 2019.
