JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Rajepur P.S. Case No. 20/2018, instituted for the offences under Sections 302, 120(B), 414 and 34 of the Indian Penal Code read with Sections 30(a) and 45 of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that on getting information that illicit liquor in huge quantity is being carried in two vehicles, police started checking the vehicles and stopped one Honda City Car and Scorpio vehicle. The driver of Scorpio Vehicle after putting back gear crushed one SAP Jawan and fled away from the place of occurrence. Later on the SAP Jawan died

Patna High Court Cr.Misc. No.50175 of 2018 (3) dt.01-10-2018 2/2 during course of treatment. The aforesaid Honda City Car was seized by the police and the person sitting in the car was arrested. The apprehended person disclosed that owner of Scorpio, namely, Vijay Mahto and driver (petitioner) were sitting in the aforesaid Scorpio vehicle. It is further alleged that huge quantity of foreign liquor has been recovered from Honda City Car. Considering the aforesaid fact and circumstances, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected at this stage. (Sanjay Priya, J.)
