The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(A), 38 and 41 of the Bihar Prohibition and Excise Act. 2581.920 litres of foreign liquor has been recovered from a truck. The petitioner and other co-accused persons are said to have involved in selling and purchasing of illicit liquor. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got one criminal antecedent of similar nature as stated in paragraph3 of the bail application. It is further submitted that there is no

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner by submitting that petitioner has got one criminal antecedent of similar nature. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Sasaram (M) P.S. Case No.112 of 2017, pending in the court of learned Special Judge, Excise Act, Rohtas at Sasaram.
