2. In this case, the petitioner is seeking regular bail in connection with Bagaha (Pathkauli) P.S. Case No. 5 of 2024, registered for the offences punishable under Section 366A, 506/34 of the Indian Penal Code.

3. As per allegation, the petitioner has kidnapped the minor daughter of the informant with the intention to marry her.

4. Learned counsel for the petitioner submits that age of the victim has been assessed in medical report between 17 to 19 years which shows that she is on the verge of maturity. He further submitted that as a matter of fact, the victim had love and affection with the petitioner and she went with the petitioner with her own sweet will and the statement of the victim under Section 164 of the

Patna High Court CR. MISC. No.64494 of 2024(2) dt.18-09-2024 2/2 Cr.P.C. was recorded under the duress of the parents. He is under custody since 18.04.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bagaha, West Champaran in connection with Bagaha (Pathkauli) P.S. Case No. 5 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
